Your acceptance of the Terms and Conditions is given when you make a purchase from the Daniel Simmons LTD website. It is important to read these Terms and Conditions carefully before buying goods from our website.

By using the Daniel Simmons LTD web services you are agreeing to all of the Terms and conditions stated, which may be updated from time to time. It is important you read the terms to take notice of any changes made.

We will endeavor to make sure that all information on our website is accurate and correct at all times and will try to resolve all information errors on the website as soon as reasonably possible.

Placing an order 

Remember to check your account and delivery information to ensure everything is correct before submitting your order as we may not be able to amend it once the order has been processed! When you submit an order, we will send you an email acknowledging receipt of your order. This does not mean that we have accepted your order. Only when your order has been shipped the order has been accepted. You will also receive a shipping confirmation email once this has taken place. If we are unable to supply you with a product, we will inform you of this in email and offer you an alternative if applicable. 

Products

The Products are owned and sold on the Website by Daniel Simmons LTD.  Daniel Simmons LTD attempts to be as accurate as possible in the description of the Products. However, we cannot guarantee that any descriptions are totally accurate, complete, reliable or error-free. The images of the products on the website are for illustrative purposes only. Although we attempt to display the colours accurately, we cannot guarantee that your computer's display of the colours accurately reflects the colour of the Products.

As a consumer, you have legal rights in relation to products that are faulty or not as described. Advice about your legal rights is available from your local Citizens' Advice Bureau or Trading Standards office. Nothing in these Terms & Conditions will affect these legal rights.

The Products sold are supplied for your domestic and private use only. You agree that you will not use the Products for any commercial, business or re-sale purposes. Daniel SImmons LTD does not have any liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

Our right to reject or cancel your order.

Fulfilment of all orders on the Website is subject to availability. We explicitly reserve the right not to accept your order for any of the following reasons: 
— The product is not available / in stock
— Your billing information is not correct or not verifiable
— Your order is flagged up by our security systems as an unusual order or an order susceptible to fraud
— We have reason to believe that you are a selling our products with no prior agreement to do so,
— We could not deliver to the address provided by you Due to an Event Outside Our Control
— In the event of misspelling, pricing or other errors or mistakes in the website information
Data Check: We may run some checks on your details before we ship your order. These checks may include verifying your address and checking for fraud. There are automated processes in place to filter out any suspicious orders which may be fraudulent. All fraudulent orders will be investigated and prosecuted if necessary.

Ordering & Availability

Products may be ordered by clicking on the items you wish to purchase and then following the prompts that will appear on-screen. You may check and correct any input errors in your order up until the point at which you submit your order to us by clicking the "Pay Now" button on the checkout page.

After placing an order, you will receive an email from us acknowledging that we have received your order and giving you an order reference number. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy a Product. All orders are subject to acceptance by us. We are not obliged to accept your order and may, at our discretion, decline to accept any order. You do, however, acknowledge that by clicking on the "Pay Now" button, you enter into an obligation to pay for the Product(s). Where we accept your order, we will confirm such acceptance to you by sending you an email that confirms that the Product has been despatched (Despatch Confirmation). The contract between you and us in relation to the Product(s) ordered (Contract) will only be formed when we send you the Despatch Confirmation. After entering into the Contract, we will be under a legal duty to supply you with goods that are in conformity with the Contract.

The Contract will relate only to the Product(s) whose despatch we have confirmed in the Despatch Confirmation. We will not be obliged to supply any other Product(s) which may have been part of your order until the despatch of such Product(s) has been confirmed in a separate Despatch Confirmation.

Price & Payment

The price of Products is as quoted on the Site from time to time.

Prices include VAT but exclude delivery costs, which will be automatically added (at the cost shown) to the total amount due when you view the items in your shopping basket, and have selected your chosen different delivery method.

Prices and delivery costs are liable to change at any time, but changes will not affect orders in respect of which we have already sent you a Despatch Confirmation.

The Site contains a large number of Products and it is always possible that, despite our best efforts, some of the Products listed on the Site may be incorrectly priced. We will normally verify prices as part of our despatch procedures so that, where a Product's correct price is less than our stated price, we will charge you the lower amount. If a Product’s correct price is higher than the price stated on the Site, we will normally, at our discretion, either contact you for instructions before despatching the Product, or reject your order and notify you of such rejection.

Payment for all orders must be made by credit or debit card on the checkout page. We accept payment by most major credit and debit cards.

You should be aware that online payment transactions are subject to validation checks by your card issuer and we are not responsible if your card issuer declines to authorise payment for any reason. We also carry out a standard pre-authorisation check on your payment card, and Products will not be despatched until this pre-authorisation check has been completed. Please note, it is possible that your card issuer may charge you an online handling fee or processing fee. We are not responsible for this.

From time to time we may run promotions where we issue discount codes. These can be used in part-payment of the price of Product(s) ordered online, subject to the Terms & Conditions under which they were issued (as indicated in our relevant promotion from which you got the code). Discount codes can only be used once, and only during the period of validity stated and only in respect of the relevant Product(s) stated. Discount codes cannot be redeemed for cash.

Risk & Ownership

The Product(s) ordered will be at your risk from the time of delivery or collection (as the case may be). Ownership of the Product(s) ordered will also pass to you on delivery or collection (as the case may be), provided full payment of all sums due in respect of the Product(s), including any delivery charges, has been received.

Currencies

We cannot be held responsible for any currency changes or currency exchange rates any bank or payment gateway may gave when exchanging the EUR, USD or GBP into any other currency.

Delivery
Your order will be fulfilled by the delivery date set out in the Despatch Confirmation or, if no delivery date is specified, then within 30 days after the date of the Despatch Confirmation, unless there are exceptional circumstances.

Your order will be delivered to the delivery address you specify when placing your order.

If your delivery address is geographically remote, for example certain outlying islands or other isolated locations, it is possible that we may not be able to deliver there. If that is the case, we will notify you before we accept your order. We reserve the right not to deliver to any country/region that is prohibited by applicable export laws. Orders cannot be delivered to PO Box or similar addresses.

Products comprised within the same order cannot be delivered to different addresses.

Deliveries are made by our trusted courier and take place on Monday to Saturday (or other normal working week days in countries/regions that do not follow a Western pattern of working week), excluding bank and public holidays, usually within the hours of 8am and 5pm. It is not possible to specify a precise time at which a delivery will take place. Please note that the courier may require deliveries to be signed for.

If you order Product(s) for international delivery, they may be opened and inspected by customs authorities and may be subject to import duties and taxes which are levied when the delivery reaches the specified destination. You will be responsible for payment of any such import duties and taxes. Please note that we have no control over these charges and cannot predict their amount. Please contact your local customs office for further information before placing your order. In the event that you return an item, the import duties will be refunded if they were originally included in the purchase price. If they were not included then you will responsible for reclaiming duty directly from your local customs office.

Please also note that you must comply with all applicable laws and regulations of the country/region for which the Product(s) are destined. We will not be liable for any breach by you of any such laws.

In certain circumstances our delivery partner may provide you with optional services when delivering your order, such as: (a) signature release: opting out of the requirement to provide a signature on delivery; (b) change your  delivery address: re-directing the delivery to a new address; (c) leave with neighbour, reception or security: re-directing the delivery to a neighbour, reception or security; (d) reschedule a new delivery date: selecting a delivery date that best suits you; and/or (e) re-directing to a collection point: collecting your order from a collection point nearby. By selecting any of these services, including through any default preferences you may have selected with our delivery partner separately, you acknowledge and agree that [client name] and Farfetch shall bear no responsibility or liability for any loss or damage that may result from delivering your order in that way. If your delivery address is in the US, this includes where our delivery partner leaves your package outside because you were not in.

Uncollected Packages

We ill not be responsible for any shipping costs to retreieve or delivery uncollected packages.

Faulty Products

If any Product you order is damaged or faulty when delivered to you or has developed a fault, you may have one or more legal remedies available to you, depending on when you make us aware of the problem, in accordance with your legal rights. If you believe a Product was delivered damaged or faulty or has developed a fault, you should inform us as soon as possible, preferably in writing, giving your name, address and order reference. Nothing in this section affects your legal rights.

Product Information

Whilst we have taken reasonable steps to depict Products as accurately as possible through the photographs and other images featured on the Site, the detailing (such as colour, pattern and texture, etc.) you see on-screen will depend on your monitor and, as such, may not exactly reflect the actual detailing of a Product when you receive it.

Become part of Daniel Simmons’ rewards programme subject to these terms and conditions (‘T&Cs’). By participating in Daniel Simmons’ rewards programme, you agree to be bound by these T&Cs.

Daniel Simmons’ rewards programme (‘DS Rewards’) is operated by Daniel Simmons LTD.

1) Becoming part of DS Rewards

To qualify for, and to participate in, DS Rewards you must have a registered account on Daniel Simmons Loyalty. If you qualify for participation in DS Rewards you will be automatically enrolled in the Rewards programme. After you have spent £500 GBP in a consecutive 12-month period (excluding cancelled orders, returns, delivery fees) (‘Rewards Value’) you will automatically be enrolled in our Silver Tier. Make sure you're subscribed to our push and email notifications, so we can send you updates about your membership and rewards, or alternatively, you can check your Loyalty Hub for these details. You can find your Loyalty Hub in your Daniel Simmons Loyalty account. You can also check and update your communication preferences in your account. If you close your Daniel Simmons account, all DS Rewards Value will be removed from your account, and you will lose your tier status. If you later create a new account, your DS Rewards participation will reset from the date on which you make a new account, as if you are a new participant. You will not be able to reinstate your previous Rewards Value on this new account.

If you have multiple Daniel Simmons accounts, these will not be merged, and you will appear as a separate customer for each account and each account could be attributed to a different tier level as applicable.

2) Eligible Purchases

DS Rewards Value is acquired by making purchases on Daniel Simmons. DS Rewards Value will be calculated based on the monetary amount that is paid by you for an order. A DS Rewards eligible purchase ('Eligible Purchase’) does not include any value attributed to a purchase (or part of a purchase) made using gift vouchers, store credit, promo codes, delivery costs or any other Daniel Simmons promotional discount. We have sole discretion over determining which purchases are Eligible Purchases for the purposes of the DS Rewards.

Rewards Value can only be earned on Eligible Purchases which are not returned or cancelled. Rewards Value acquired will be converted into points and applied to your account after 14 days however please note that order values will not be added until their returns window has expired. The returns window is indicated in Daniel Simmons’ website terms and conditions. We may amend such period at our sole discretion at any time without notice. Any amendment will be binding upon publication on Daniel Simmons’ website. Make sure you regularly check the most recent version of our website terms and conditions and these T&Cs for the latest updates.

3) Tiers

There are five DS Rewards tier threshold values which are as follows:

  • Bronze: 0 - 499 Points (£0 - £499 GBP)
  • Silver: 500 - 2,499 Points (£500 - £2,499 GBP)
  • Gold: 2,500 - 4,999 Points (£2,500 - £4,999 GBP)
  • Platinum: 5,000 - 9,999 Points (£5,000 - £9,999 GBP)
  • VIP: 10,000+ Points (£10,000+ GBP)

The rewards tier benefits will be valid for 12 months unless you move up a tier. Once you have accrued enough Rewards Value to take you to the next tier, and the value of any Eligible Purchases has been applied to your account in accordance with these T&Cs, we will automatically move you up, extending the benefits of your new tier for a further 12 months.

Each tier unlocks additional or better rewards, such as exciting discounts, early sale access, shipping rewards, welcome rewards, and your annual birthday reward. Each reward may be subject to additional and specific terms and conditions as indicated on your Loyalty Hub.

4) General Rewards Information

You should ensure that the contact information on your Daniel Simmons account is accurate and up to date. We will not be responsible for any DS Rewards Value which is not applied to your account because of inaccurate details provided by you.

All orders placed on Daniel Simmons will be subject to Daniel Simmons’ website terms and conditions, which can be found here. DS Rewards value is non-transferable, non-exchangeable and no cash alternative is available.

You understand and agree that we may use data from your Daniel Simmons account, for the purposes of analysis and so that specific recommendations and offers may be made to you. For more information on how Daniel Simmons uses your personal data and what your rights are under data protection law, please refer to our Privacy Policy.

You can update your email communication preferences in your account. Alternatively, follow the instructions for unsubscribing at the bottom of Daniel Simmons promotional emails.

We may review and amend the benefits and tier thresholds at our sole discretion at any time.

We reserve the right to refuse, close or merge additional Daniel Simmons accounts at any time.

In the event of a dispute regarding DS Rewards or these T&Cs, the decision of Daniel Simmons is final, and no correspondence or discussion shall be entered.

We may cancel, withdraw, or alter these T&Cs and the DS Rewards programme or benefits at any time without notice. We will communicate material changes to you.

We reserve the right to close your account or remove you from DS Rewards at any time if we reasonably believe you have been acting fraudulently or in breach of these T&Cs.
